Cruisin’ for a Cause Car Raffle: Terms & Conditions

The Cruise for a Cause Car Raffle (the “Raffle) is a fundraising raffle to support Forward Training Center of Hood County’s (“FTC”) efforts to educate, support and inspire life-changing growth in men and women. With 100% of the money raised through the Raffle going to support these efforts. You can learn more about our mission and programs by visiting our website at www.forwardtrainingcenter.org.

  1. TO ENTER: From September 20th, 2024 until December 13th at 11:59 PM, (during the “Entry Period”), entrants may enter the Forward Training Center of Hood County’s Cruisin’ for a Cause Car Raffle (“Raffle”) by purchasing a raffle ticket through the Forward Training Center (“FTC”) website at https://forwardtrainingcenter.org/cruisin-for-a-cause-raffle/ and completing a registration form which will include full name, telephone number, e-mail address, and other contact details (if available).

    A. NOTE: DEADLINE TO PURCHASE TICKETS ONLINE IS 11:59PM, DECEMBER 13, 2024, OR WHEN TICKETS SELL OUT, WHICHEVER COMES FIRST. THE ACTUAL DRAWING WILL BE ON DECEMBER 14, 2024 AT 10:00AM.

  2. TICKET PURCHASING: By purchasing a ticket, purchasers (on behalf of themselves and any other named ticket holder) agree to be bound by these Official Rules and by all decisions of FTC with respect to the Raffle. The Raffle is conducted in the state of Texas, the state where FTC is based and, as such, is being conducted and governed according to Texas law. Tickets can only be purchased in the state of Texas via the internet at https://forwardtrainingcenter.org/cruisin-for-a-cause-raffle/. A ticket is “sold” for the purpose of calculating the number of tickets sold when FTC receives full payment for that ticket. Only 500 tickets will be sold. Odds of winning depend upon the number of eligible entries received, not to exceed 500 tickets sold (void where prohibited). There are no limitations on the number of tickets purchased by an individual. Once purchased, tickets become the sole property of FTC and will not be returned. The deadline to be eligible for the drawing is to purchase a ticket or tickets is before 500 tickets are sold or by the given deadline, whichever comes first. Anyone attempting to buy a ticket after 500 tickets have been sold will be denied.
    A. By purchasing a ticket, each participant agrees to be bound by and adhere to the terms and conditions contained in these rules. The ticket confirmation email will be sent to the email address you provide during the purchasing process. We are not responsible for any lost or misdirected email. If you do not receive your Raffle ticket email confirmation message within 24 hours after purchase, you should contact FTC directly by email at [email protected] or 817-573-6677.
  3. OFFICIAL DRAWING & DETERMINATION OF WINNER : The official drawing for the winning ticket will take place on December 14, 2024 at approximately 10:00am at the Forward Training Center of Hood County (600 W Pearl Street, Granbury, TX 76048) and conducted by FTC staff. The prize winner need not be present to win, as the drawing and winner announcement will be broadcast via a Facebook Live video through FTC’s Facebook page. The winner will then be notified by telephone, mail and/or email on the same day as the Raffle drawing.
    A. If the winner cannot be reached after a reasonable effort has been extended within 7 days after the initial drawing), is determined to be ineligible, or cannot or does not comply with our Official Rules. by December 21, 2024 (within 7 days after the first notification attempt on the day of the raffle drawing), the winner will be disqualified. If the winner cannot be reached after a reasonable effort has been extended, is determined to be ineligible, or cannot or does not comply with our Official Rules. FTC will have made a reasonable effort to reach a winner if it has made at least two attempts to contact the winner via phone or by the email address provided when purchasing his/her ticket and/or within 7 days of the official drawing.
    B. If a winner cannot be reached/located, is disqualified or declines acceptance of the prize, FTC will redraw to identify an alternate winner selected by random drawing from the remaining tickets sold. PRIZE MUST BE CLAIMED BY Saturday, December 28, 2024 (14 days after the raffle). FTC is not responsible for problems occurring through telecommunications, the postal service or the Internet, which may affect the winner’s receipt of the prize notification.
  4. ELIGIBILITY: The Raffle is open to legal residents of the State of Texas, United States, who are physically located in the State of Texas, United States and who are 18 years of age or older at time of purchase. The Raffle is void where prohibited. Employees of FTC and their immediate families are not eligible to win the prize. Immediate family is defined as, through either blood or marriage, one degree of familial relationship (including in-laws and step-family), such as your spouse, your siblings, your parents, and your children. Immediate family does not include other family members (including in-laws and step-family), such as grandchildren, grandparents, nieces, or nephews.
  5. CONDITIONS: An eligible entrant may only enter via the ticket purchasing methods as described above. Incomplete entries are void. By entering, entrants acknowledge compliance with these official rules including all eligibility requirements. All entries become the property of FTC and will not be returned. Neither FTC nor advertising and promotion agencies are responsible for incorrect or inaccurate transcription of entry information, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. No copies, facsimiles, or reproductions of entries will be accepted.
  6. DETERMINATION OF WINNER: The winner will be notified by telephone, mail, and/or email and will be required to complete an affidavit of eligibility and release, which must be completed and returned within seven (7) days of issuance of notification or an alternate winner will be selected. All decisions of the FTC are final and any attempt to deliberately damage the content or operation of this Raffle is unlawful and subject to legal action by FTC or its agents.
    A. NOTE: TICKETS PURCHASES ARE NOT TAX-DEDUCTIBLE OR REFUNDABLE. PRIZE MUST BE CLAIMED BY SATURDAY, DECEMBER 28, 2024 (WITHIN 14 DAYS OF THE RAFFLE DRAWING). THE PRIZE IS ALSO NON-TRANSFERABLE AND CANNOT BE EXCHANGED FOR CASH.
    1. FTC MAY USE THE WINNER’S NAME AND LIKENESS FOR PUBLICITY PURPOSES WITHOUT FURTHER COMPENSATION. FTC IS NOT RESPONSIBLE FOR ANY FAILURE OF COMMUNICATIONS OR FAILURE OF THE INTERNET OR ITS WEBSITE. FTC RESERVES THE RIGHT TO MODIFY THESE RULES AND WILL GIVE PROMPT ANNOUNCEMENT OF ANY RULE CHANGES. ALL DECISIONS OF FTC ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THIS RAFFLE.
  7. PRIZE & REQUIREMENTS FOR CLAIMING: There is one (1) prize: a 2015 Ford Mustang GT Premium car with an estimated value of $20,000. This prize must be formally accepted in writing by December 28, 2024. The winner will be required to sign an Affidavit of Eligibility and Publicity/Liability Release, show proof of a valid driver’s license and, if possible, a printed copy of their confirmation email that they received after purchasing tickets(s), in order to claim the prize. FTC reserves the right to revoke any prize or remove a purchased ticket if the ticket holder does not meet any or all of the eligibility requirements, or if the purchased ticket has been damaged or altered. By purchasing a ticket, purchasers (on behalf of themselves and any other named ticket holder) agree to be bound by these Official Rules and by all decisions of FTC with respect to the raffle.
  8. TAX, TITLE, LICENSE, AND INSURANCE OBLIGATIONS: By entering this raffle, each prize winner is solely responsible for all license fees, which are due at the time the vehicle is purchased and transferred to the winner. Upon transfer of the vehicle title from FTC to the winner, the winner will also be responsible for adequate insurance coverage. Each winner is also responsible for all taxes (including federal, Texas and local taxes, if any), as well as registration, insurance and other expenses incurred with claiming the prize. Appropriate reporting forms to the winner, the IRS and Missouri will be provided. In order to award the prize, the winner must complete all appropriate documents required to take possession of the prize. The winner will receive the appropriate IRS Form from FTC (for the calendar year the prize was awarded) for the total value of the prize determined by FTC. If a winner chooses to forfeit his/her prize, he/she must do so prior to taking possession of the prize. The IRS requires withholding for non-cash prizes with a value exceeding $5,000 after deducting the cost of the winner’s ticket. The withholding tax must be paid prior to possession of the prize.
  9. or the use of any prize even if such loss or damages results from or is caused or contributed to by the fault or negligence of FTC, its directors, officers, employees, volunteers and agents.
    A. LIMITATIONS ON LIABILITY AND DISCLAIMERS: In no event shall FTC, its directors, officers, employees, volunteers and agents from any and all liability for injuries, losses or damages of any kind (including, without limitation, attorney’s fees) resulting from or caused by participating in the Raffle or by winning any prize or resulting from acceptance, possession, use or misuse of any prize, even if such loss or damages results from or is caused or contributed to by the fault or negligence of FTC, its directors, officers, employees, volunteers and agents. By entering this Raffle, each entrant agrees to indemnify and hold FTC harmless from any and all losses, damages, rights, claims and actions of any kind resulting from or arising from, in connection with participating in the Raffle or the winner’s acceptance or use of any prize. FTC will not be responsible for or liable to any prize winner, winner’s family, or estate for any submissions of entries that are lost, late, illegible, damaged, incomplete, or incorrect. FTC can, at any time it chooses without recourse, decide to terminate or modify the Raffle if the integrity of the Raffle appears to be compromised. If the Raffle is canceled, all monies paid for raffle tickets will be returned to entrants. Decisions of the FTC related to the winner, interpretation of official rules, and other matters related to this Raffle are final.
    1. A. FTC makes no warranty of any nature with respect to the raffle or the prize, whether in respect of fitness for a particular purpose, satisfactory quality or otherwise. Entrants acknowledge that, except as specifically set forth herein, FTC has not made and disclaims all liability for any warranty, representation or guarantee, express or implied, in fact or in law, related to the raffle or the prize. All entrants, by entering, agree to be bound by these official rules. By accepting the prize, winner agrees to release FTC, its directors, employees, officers, or agents, from any and all liability, loss, or personal or property damages arising directly or indirectly out of or in connection with the awarding, receipt, accepting, using or misusing of the prize or participation in any prize-related activities.
  10. GOVERNING LAW: This Raffle is subject to all applicable federal, state, and local laws. All disputes surrounding the Raffle and any prize awarded hereunder will be subject to the substantive laws of Texas. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
  11. ADDITIONAL REQUIREMENTS: . Winner consents to the use of his or her name, biographical information, photographs and/or likeness for advertising and publicity purposes without additional compensation, except where prohibited. FTC reserves the right to verify eligibility qualifications of the winner. Purchased tickets are not tax deductible nor considered a donation to FTC. Winners and guests must demonstrate appropriate and respectful behavior during the event and prize transfer processes, inappropriate behavior may result in forfeiture of the prize. The winner will be required to sign a Liability Release, as well as show proof of a valid driver’s license and a ticket confirmation email with their ticketing information in order to claim the prize.
